THE Lusaka High Court has ordered former Zambia’s Ambassador to Ethopia, Emmanuel Mwamba to recant his scandalous statement and issue an apology to political critic Sishuwa Sishuwa.
Last year, Dr Sishuwa sued sued Mr Mwamba demanding compensatory and exemplary damages for vilification following an article in the Mail and Guardian.
Mr Mwamba indicted Dr Sishuwa of being a abettor of a certain political party, further professing that he embarked on sabotaging the country after realising that the same party would not win the August election.
still, in a concurrence judgement delivered on June 14, this year, Judge Ruth Chibbabbuka has ordered Mr Mwamba to publish the apology on his Facebook page on which the scandalous article was published and other social media pages on which he caused the same to be published, namely, Smart Eagles and Ask Muvi TV.
She further stated that Mr Mwamba should publish the apology prominently in at least one edition of the News Diggers Newspaper and the Zambia Daily Mail.
She also ordered Mr Mwamba to pay nominal damages in the sum of K30,000 and costs in the sum of K50,000.
“ Should the defendant fail, refuse or neglect to perform any of his scores under this judgement within 30 days from the date hereto, the complainant shall be at liberty to apply this judgement without further recourse to the court and may levy execution in respect of any totalities owed to the defendant under this judgement or any part thereof which may still be outstanding, ” judge Chibbabbuka said.
